You don't need a bunch of rules telling you what you can and can't do, so we'll keep it simple:

• No spamming
• No hacking into people's sites
• No pornography
• No IRC or psybnc clients
• No warez, or any other illegal activity
• Payment is due within two weeks of receiving your invoice.(paypal accepted).
• You may not resell space on your account.
• You maintain the rights to all your data, files, and other information.
• You're responsible for backing up your own website.
• You can cancel at any time, and we'll refund any unused hosting fees via paypal.
• If you are not satisfied with our services you can request a refund at any time within the first 30 days. Open a support ticked with the subject "refund" in your client area.
• We reserve the right to cancel your account for any reason, provided we give you 30 days notice.. (but hopefully, that'll never happen!)
• We reserve the right to cancel any account immediately for breaking these rules.
• We also reserve the right to suspend accounts or kill processes that interfere with the smooth operation of our servers.
• We may change these rules at any time, and will notify you immediately if we do.

Oh, and by the way: We won't share your personal information or email address with anyone. ... But we'll gladly link to your site, if you let us!

Account Setup
We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) incase of fraud. It is your responsibility to provide us with an email address which is not @ the domain(s) you are signing up under.

Cancellation and Refunds
UltimateWebHost.info reserves the right to suspend any account at any time on receipt of Abuse complaints. Customers may cancel at any time they wish to. UltimateWebHost.info gives you an unconditional 30 day money back guarantee on shared hosting, reseller hosting. There are no refunds on dedicated servers and new domain registrations. Refund requests after 30 days will be refunded on a prorated basis of any unused time. Only first-time accounts are eligible for a refund.

For example, if you've had an account with us before, cancelled and signed up again, you will not be eligible for a refund or if you have opened a second account with us. There will be no refund for new domain registrations, cPanel or Dedicated Server License.

Money back Guarantee
On dedicated servers no refund will be honored, the 30 day money back guarantee does not apply. We reserve the right to refund a prorated amount or no refund at all. Each of UltimateWebHost.info's managed shared, reseller hosting plans carries a 30 day unconditional money back guarantee on them. If you are not completely satisfied with our services within the first 30 days of your account setup, you will be given a full refund of the contract amount. Remember, this is ONLY for shared and reseller hosting packages and not for dedicated servers.

OPTIONAL SERVICES
These services include but are not limited to: Fantastico package, Mailing Lists and others, are provided WITHOUT WARRANTY and WITH NO GUARANTEE OF RESULTS.

SERVICE GUARANTEES
99.9% Network Uptime Guarantee
UltimateWebHost.info guarantees that your website will be up and running at least 99.9% of the time during any 12-month period. This guarantee includes network uptime, server uptime, web server and service uptime. However, we cannot be held responsible for upstream problems outside of our network and areas where UltimateWebHost.info has no direct influence, such as backbone provider failures, fibre-optic main line cuts, DNS or Registrar problems with subscribers’ domain names, routing problems between clients’ location and our data center. The uptime guarantee is also not applicable if the service interruption was caused by any natural or unnatural events that UltimateWebHost.info cannot directly influence. UltimateWebHost.info may temporarily deny or terminate service upon clients’ failure to pay their charges when due.

UltimateWebHost.info will guarantee 99.9% UltimateWebHost.info network uptime and 99.9% network stability uptime. This, however, does not refer to problems stemming from:

1. Server Hardware Breakdown
2. User error(s) or purposeful interruption(s) (e.g. if the client shuts his/her own server down, UltimateWebHost.info is not responsible for the downtime)
3. Failures due to software that is not explicitly supported by UltimateWebHost.info Consequently, if a hardware crash provoked by the customer happens, UltimateWebHost.info has no responsibility for the resulting downtime

Network Outages or Unscheduled Downtime is any unplanned or unexpected interruption in the network availability due to a hardware, software, network connectivity or data center problem, during which a 100% packet loss is experienced.

Scheduled Downtime is any scheduled interruption of services for the purpose of network upgrades, or replacement of any equipment in order to provide a better service for you. Scheduled downtime occurs during notified downtime periods, with as many warnings sent in advance as possible via e-mail or posted on our news section at a minimum 24-hour notice.

SERVER USAGE & HOSTED CONTENT

1. Server content MUST comply with the parameters stated in this agreement. Web content requirements exclude the publication of illegal content or content considered inappropriate otherwise. Customers should get in touch with a UltimateWebHost.info Service representative regarding any inquiries over the matter.
2. If any of UltimateWebHost.info’s Services are used for the illegal purpose of SPAM or UCE, then they will be instantaneously terminated.
3. Unauthorized Access. UltimateWebHost.info expressly bans the use of any UltimateWebHost.info hardware or software hosted on a UltimateWebHost.info server for trying to illegally access another hosted machine or network.
4. Each customer will be able to take advantage of the package he/she has purchased at the introductory price levels and with one and the same set of features in the course of the whole contract period. UltimateWebHost.info reserves the right to introduce certain changes to the packages (in the shape of complementary services) to the benefit of customers.

SPAMMING IS PROHIBITED
We will determine at our sole discretion whether any of the messages you send are spam. For your information, spamming generally includes, but is not limited to:

1. the sending of unsolicited messages in bulk, or the sending of unsolicited e-mails, which provoke complaints from recipients
2. the sending of junk mail
3. the use of distribution lists that include people who have not given specific permission to be included in such a distribution process
4. posting commercial ads to USENET newsgroups that do not permit it
5. posting articles containing binary encoded data to non-binary newsgroups
6. excessive and repeated posting of off-topic messages to newsgroups
7. excessive and repeated cross-posting
8. e-mail harassment of another Internet Customer or Customers, including but not limited to the transmission of any threatening, libelous or obscene material, or material of any nature which could be deemed offensive
9. the e-mailing of age-inappropriate communications or content to anyone under the age of 18
10. "Spamming" is considered an explicit misuse of ethical principles and will be interpreted as a violation of them
11. The maximum number of allowed e-mail messages sent per day is 1500. There are no exceptions to this rule. Every customer who is sending more than 1500 e-mail messages per day needs a dedicated server and cannot use a shared hosting account.

ABUSE
Any attempts to undermine, slander, libel, threaten, or cause harm to a UltimateWebHost.info server, customer, employee, or the company directly is strictly prohibited and is grounds for immediate termination without refund. In addition, we will pursue all attempts to the fullest extent of the law.

Please report any violations of the Terms of Service and the Domain Name Dispute Resolution Policy (which too is an integral part of this document) to abuse@UltimateWebHost.info.info.

UltimateWebHost.info disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by UltimateWebHost.info and its employees.
